The 529 plan gets its name from Section 529 of the Internal Revenue Code, which was enacted as part of the Small Business Job Protection Act of 1996. The original provision was quite limited, covering only prepaid tuition plans. The tax-free treatment of earnings was not made permanent until the Pension Protection Act of 2006. Today, 529 plans hold over $450 billion in assets across approximately 16 million accounts, with an average account balance of approximately $28,000.
